UpTrust Usage Agreement
An agreement between UpTrust and its patrons outlining the responsibilities, rights, and shared culture that make UpTrust the most trusted place on the internet for nuanced conversations.
Welcome to UpTrust. While this document is long and may contain some legalese, we encourage you to read it all so you know what you're agreeing and contributing to.
By accessing or using our platform, you agree to comply with and be bound by the following terms and conditions. If you aren't on board with any of the below we encourage you to not use the platform or reach out to our team to make suggestions for how these terms could be updated at support@uptrusthq.com.
1. Welcome & Basic Agreements
By accessing UpTrust and its services, you agree to comply with our Usage Agreement and Privacy Policy. If you use our services, you agree to these terms. UpTrust reserves the right to update or modify these terms at any time, and continued platform use constitutes acceptance of those changes. However, we will always do our best to notify you of changes.
2. Who can use UpTrust?
You must be at least 18 years old to use UpTrust. By creating an account, you affirm that you are fully able and competent to enter into this agreement and comply with the terms.
3. Creating and Managing Your Account
To access certain features of UpTrust, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and any activities under your account. You agree to notify UpTrust immediately of any unauthorized use of your account. UpTrust is not liable for any losses caused by unauthorized use of your account. Make a good password! UpTrust will never ask for your password.
4. Minimum Community Guidelines
By using UpTrust, you agree to:
- use the platform only for lawful purposes.
- Not harass, abuse, or harm others.
- Not upload or share content that is illegal, offensive, or violates the rights of others.
- Respect the intellectual property of UpTrust and other users.
UpTrust reserves the right to terminate or suspend your account if you violate these terms or engage in any activities that harm the platform or its users.
5. Who Owns What You Share
User Content:By uploading or posting content to UpTrust, you retain ownership of your content but grant UpTrust a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute your content for the purpose of operating and improving the platform. We're not trying to exploit your content - we just need the technical permissions to make the platform work (think: displaying posts, letting users share your genius, making sure it loads on phones, creating backups).
UpTrust Content:All content provided by UpTrust, including text, graphics, logos, and software, is owned by UpTrust or its licensors and is protected by intellectual property laws.
6. How We Work With Third-Party Services
UpTrust integrates third-party services, including but not limited to Google Fonts, UploadCare for image uploads, and analytics services like Grafana and Mixpanel. We are not responsible for the practices of these third parties. By using UpTrust, you agree to comply with the terms and policies of these third parties as applicable. If they're doing shady stuff, we're going to use a different service.
7. Conditions for Account Termination
UpTrust reserves the right to terminate or suspend your account without notice if you violate any part of these Terms of Service, engage in harmful behavior, or misuse the platform in any way. Upon termination, your access to the platform and its content will cease immediately.
8. Dispute Resolution & Governing Law
In the event of a dispute between you and UpTrust, both parties agree to resolve the issue through binding arbitration as per the laws of Texas, United States. By using UpTrust, you waive the right to participate in class actions and agree that any dispute will be handled individually.
9. Limitation of Liability
UpTrust provides its services on an "as-is" basis without any warranties. We do not guarantee the platform will be uninterrupted, secure, or free of errors. (Nor could we if we wanted to). UpTrust is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform.
10. Changes to the Terms
UpTrust may modify these Terms of Service at any time. We will notify you of significant changes, and your continued use of the platform after the changes take effect will constitute acceptance of the new terms.
11. Governing Law
These Terms of Service are governed by the laws of Texas in the US, without regard to its conflict of law principles. Any legal actions or proceedings related to your use of UpTrust must be brought in Texas court.
